Une version française de ces conditions est offerte : Conditions en français.

1. Who we are

"Kilo", "we", "us" and "our" mean Timeless Mechanics Inc. We design and build the Kilo, a hand-powered espresso machine, in Vancouver, British Columbia. "You" means the person using this website or paying a reservation deposit. This website is kilobrewer.com, including our store, which runs on Shopify.

2. Accepting these terms

These terms apply when you use this website or pay a reservation deposit. Please read them before you pay. By paying a deposit, you agree to these terms, our Refund Policy and our Privacy Policy.

To pay a deposit, you must be an adult with the legal capacity to make a contract where you live.

Your rights under consumer law come first. Nothing in these terms limits any right you have under British Columbia's Business Practices and Consumer Protection Act, BC's Sale of Goods Act, or any other consumer protection law that applies to you and can't be waived. If any part of these terms conflicts with those laws, the law applies.

3. The Reservation Program

3.1 What we sell right now

Right now we sell reservation deposits, not machines. A deposit reserves a Kilo at a locked price. You buy the machine itself through our Kickstarter campaign.

Founder's Circle (20 spots)

  • Deposit paid here: US$99
  • Your private Kickstarter reward: US$900
  • Your total for the machine: US$999, shipping included, shown on Kickstarter before you pledge. Duties and import taxes, if any, aren't included (section 5).
  • Your private link goes out first on launch day
  • Included with your machine when you pledge (see 3.10): your Kilo is one of the first 20 we build and ships before any other backer's or customer's Kilo; a numbered Founder's plate (No. 001–020) with your name and the name of the person who built it; a 10-year extended warranty; a one-to-one call with Mika, our founder; photos of your machine on the bench before it ships; and the lowest price for the machine on our Kickstarter campaign

Priority Access (99 spots)

  • Deposit paid here: US$55
  • Your private Kickstarter reward: US$1,040
  • Your total for the machine: US$1,095, plus shipping, shown on Kickstarter before you pledge
  • Your private link goes out on launch day, after Founder's Circle
  • Included with your machine when you pledge (see 3.10): your Kilo ships right after the Founder's Circle machines, before any public backer's; a numbered First Edition plate (No. 021–119); a one-to-one call with Mika, our founder; a photo of your machine on the bench before it ships; and your price is locked before the public sale

3.2 What a deposit is, and what it isn't

A deposit is:

  • a payment that holds one spot in your tier;
  • your right to receive, on launch day, a private link to a Kickstarter "Secret Reward" for your tier, priced at your locked total minus your deposit;
  • refundable on request, as set out in the rules in 3.4.

A deposit is not:

  • the purchase of a machine: you buy the machine when you pledge on Kickstarter;
  • a promise of a delivery date: we haven't set one yet;
  • an investment, or a share in our company;
  • a gift card or store credit.

3.3 How it works

  1. You pay your deposit here.
  2. Our Kickstarter campaign is planned to launch on November 1, 2026, in US dollars. The moment it goes live, and before we announce it publicly, we email you your private link. Founder's Circle links go out first, then Priority Access, all on launch day. We send it to the email address you used at checkout.
  3. Your Secret Reward is priced at your locked total minus your deposit: US$900 for Founder's Circle, US$1,040 for Priority Access.
  4. When you pledge using your private reward, and Kickstarter collects your pledge, your deposit becomes part of what you've paid for your machine.
  5. On launch day we stop selling deposits here.

If the launch date changes, we'll email you the new date. Your deposit stays refundable on request (rule 1).

3.4 The deposit rules

  1. Before you pledge, your deposit is refundable on request. Email hello@kilobrewer.com and we refund it in full within 15 days.
  2. Once you pledge on Kickstarter using your private reward, your deposit becomes part of what you've paid for your machine.
  3. If you don't pledge, or you cancel your pledge (subject to Kickstarter's rules), you can still ask for your deposit back until 60 days after the campaign ends. We don't send a reminder, so please note this deadline. Deposits not claimed by then are kept as support for the Kilo project and can't be refunded after that.
  4. If the campaign doesn't reach its goal, the same applies. Ask for your deposit back until 60 days after the campaign ends.
  5. If the campaign hasn't launched by March 31, 2027, we refund every deposit automatically. You don't need to ask.
  6. One deposit per person. Pledge with the same email you use here. Your private link is personal.
  7. The deposit-holder price only exists while the Kickstarter campaign is live.

Whenever you ask for a refund that these rules allow, we refund your deposit in full, to your original payment method, within 15 days of your request.

"Kept as support" isn't a donation. We can't issue a tax receipt for it. It doesn't give you anything beyond what your deposit already supplied: your private link. The tier benefits in 3.10 come with a machine you pledge for, so they don't apply to a deposit kept as support.

More about pledges:

  • If Kickstarter doesn't collect your pledge (for example, your card fails and isn't fixed in time), we treat it as if you didn't pledge, and rule 3 applies.
  • Kickstarter's own pledge rules apply. For example, in the last 24 hours of a campaign, Kickstarter doesn't let you reduce or cancel a pledge if that would drop the project below its goal.
  • If you pledged with a different email, write to us before the campaign ends and we'll match it by hand.

Your statutory rights still apply. If we don't send your private link on launch day, or if we didn't give you the information or contract copy that BC law requires, you may have a right to cancel and get your money back under the Business Practices and Consumer Protection Act, whatever the 60-day deadline says.

3.5 One per person, and your private link

  • Each person may hold one deposit. If we find more than one deposit for the same person, we keep the first one and refund the others in full.
  • Your private link is personal. If it's shared or used by someone who doesn't hold a deposit, we may cancel the matching deposit and refund it in full.
  • We match deposits to pledges by email address. Our Privacy Policy explains how.

3.6 Switching tiers

You can switch tiers while spots remain in the other tier. We refund your current deposit in full, and you pay the other tier's deposit as a new reservation.

3.7 Your price

Your locked total applies only through your private Secret Reward, and only while the campaign is live. We won't raise the price of your Secret Reward after you've paid your deposit.

"Your price is locked before the public sale" (Priority Access) and "the lowest price for the machine on our Kickstarter campaign" (Founder's Circle) mean this: no public Kickstarter reward for the same machine, including any early-bird reward, will be priced at or below US$1,095.

3.8 If the launch is delayed or doesn't happen

  • If the launch date changes, we'll email you the new date.
  • If we decide not to run the campaign, we'll tell you by email. You can ask for your deposit back at any time (rule 1).
  • If the campaign hasn't launched by March 31, 2027, we refund every deposit automatically within 15 days after that date (rule 5).
  • We haven't set a delivery date for the machine. We'll publish an estimated delivery date, and the refund terms for the machine, on Kickstarter before you pledge.

3.9 How this relates to Kickstarter's terms

  • There are two separate contracts. Your deposit is a contract with us, made on this website. Your pledge is a contract with us, made on Kickstarter under Kickstarter's Terms of Use. Kickstarter isn't a party to either one.
  • These terms cover your deposit. Kickstarter's terms, our campaign page and the reward description cover your pledge and the machine.
  • If these terms and Kickstarter's terms conflict about your deposit, the one more favourable to you applies.
  • Once the campaign is live, we don't take new deposits.

3.10 Your tier benefits

The benefits listed in 3.1 come with your machine. You get them when you pledge using your private reward and Kickstarter collects your pledge. A deposit on its own holds your spot and your plate number, and gets you your private link.

  • Delivery order. Founder's Circle machines ship first, then Priority Access machines, then machines for public backers. This is an order, not a date. The estimated delivery date is on Kickstarter before you pledge (3.8).
  • Shipping included (Founder's Circle). We pay to ship your machine to your address, in any country we ship to. Kickstarter shows where we ship before you pledge. Duties, import taxes and customs fees, if any, aren't included (section 5).
  • Plates. Founder's plates are numbered 001 to 020, and First Edition plates 021 to 119. We give numbers in the order deposits are paid. If a deposit is refunded, we may give its number to the next person who reserves. On a Founder's plate, we put your name as you give it to us, shortened if it doesn't fit. You can choose no name, and we can refuse wording that isn't a name or is offensive. The plate also names the person who built your machine.
  • Warranties. Founder's Circle machines come with a 10-year extended warranty; the other tiers come with our standard warranty. The full terms of each (what's covered, what isn't, and how to make a claim) are published before you pledge on Kickstarter. A warranty adds to your rights under consumer law; it doesn't replace them.
  • One-to-one call with Mika (Founder's Circle and Priority Access). One video call with Mika, Kilo's founder, to pull your first shot together or before your machine ships, at a time we agree by email.
  • Bench photos. Before your machine ships, we email you photos of it on the bench (Founder's Circle) or a photo (Priority Access).

4. Prices and currency

  • Prices on this site are in US dollars (USD), and deposits are charged in US dollars wherever you live. If your card is in another currency, your card issuer converts the charge at its own rate and may add a fee. We don't control those fees.
  • There are no added fees from us at checkout. Nothing ships now, so there's no shipping charge for a deposit.
  • If we make a pricing error, we'll tell you before we accept your deposit, or refund you in full if we've already charged you.

5. Taxes

Taxes, if any, are calculated at checkout. Taxes and import duties on the machine will be shown on Kickstarter before you pledge.

6. Accuracy of information

The Kilo is still in development. Photos, renderings, specifications and descriptions show our current design and may change before production. If a change is material to your decision (for example, a change to the tier benefits or your locked price), we'll tell you by email before the campaign launches, and you can get your deposit back in full.

7. Intellectual property

The Kilo name, logo, designs, photos, videos and text on this site belong to us or our licensors. You may view and share our pages for personal, non-commercial use. Don't copy, sell or use them to make a competing product without our written permission. This doesn't limit any use the law allows, such as fair dealing.

8. Acceptable use

When you use this site, don't:

  • break any law;
  • try to get more than one deposit per person, or share or resell a private link;
  • interfere with the site's security or operation;
  • use bots or scripts to buy deposits;
  • give false information at checkout.

If you break these rules, we may cancel your deposit. If we do, we refund it in full.

9. Disclaimers and limits on our liability

9.1 Rights you always keep. Nothing in these terms:

  • limits any right or remedy you have under the Business Practices and Consumer Protection Act (BC);
  • excludes or limits the conditions and warranties implied by BC's Sale of Goods Act where the law says they can't be excluded;
  • limits our liability for fraud, for deliberate or grossly negligent acts, or for death or personal injury caused by our negligence;
  • stops you from taking part in a class proceeding, or requires you to use arbitration;
  • stops you from posting an honest review of us or our products.

9.2 The website. We provide this website "as is". We don't promise it will always be available or free of errors. This doesn't affect 9.1.

9.3 The deposit. Our total liability to you in connection with your deposit is limited to the amount of your deposit, except where 9.1 applies or the law gives you more.

9.4 Indirect losses. To the extent the law allows, we're not responsible for losses that weren't reasonably foreseeable when you paid your deposit.

10. Governing law and disputes

  • These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there.
  • If you have a problem, please email hello@kilobrewer.com first. We'll try to fix it.
  • You can bring a claim in the courts of British Columbia or, where it has jurisdiction, BC's Civil Resolution Tribunal. If you live outside British Columbia, you may also have the right to bring a claim, and to rely on consumer protection laws, where you live.

11. Changes to these terms

  • We may update these terms. We'll post the new version here with a new "Last updated" date.
  • A change won't apply to a deposit you've already paid if it increases what you owe or reduces what we owe you, unless you agree to it. If we need to make that kind of change, we'll email you at least 30 days before it takes effect, and you can get your deposit back in full instead.
  • Changes that only fix typos, update contact details or reflect a change in law may take effect when posted.
